Department of Education schools are currently operating under four copyright licensing agreements. These agreements give Victorian schools certain copying rights in the areas of:
Schools do not need to have individual membership to any of these collecting societies, as membership is organised centrally on a per capita basis. Schools also do not need to keep any records of copying unless a particular school is selected as a sample school. Approximately seventy schools are sampled in Victoria every two years, and these schools are expected to keep detailed records for one term. These samples are organised by AC Neilsen and are essential to the smooth administration of the licensing agreements. Follow these links to read the agreements. Itinerant and part-time instrumental music teachersAre you covered by the AMCOS agreement? Individual lessons: No! If you teach individual instrumental or vocal lessons in a school either during school hours or before/after school you are NOT covered by the AMCOS licence. For example, if you teach flute part-time at a school to individual students or even small groups, you may not copy any music unless you have permission directly from the publisher. If you give private lessons on school premises and you are employed by the school or if you rent the school premises for your lessons, you are treated as a Private Music Teacher and therefore excluded from the AMCOS agreement. Please read the AMCOS copyright guideline prepared for private music teachers. Part-time class music teaching: Yes! If you teach music as a subject at a school or conduct a choir or orchestra, you are allowed to rely on the limits of the AMCOS agreement. You must not make more than one set of photocopies from the original music. For example, if you teach one class at 10 different schools you may only photocopy the music 5 times if a choral sheet, 15 (secondary)/30 (primary) times if a song from a vocal score, and a total of 30 additional copies if an orchestral piece. You cannot take the same piece of original music to the other nine schools and make further copies of the music. Remember to mark the original music and the copies!
